Be prepared for AWR September 2011

Temporary employees will become entitled to equal treatment when compared with their full-time counterparts after 12 weeks of working on an assignment.

Equal pay and hours, overtime, holidays, breaks, access to vacancies and other company facilities will be available to agency staff once they have completed the qualifying period.

The Agency Workers Regulations (AWR) come into force on 1 October 2011. Companies are being urged to make sure that they are prepared for the changes, and to ensure that they are able to accurately monitor the length of service of any temporary employee. This is particularly true given that elements such as sick leave, holiday, maternity leave etc will have an impact on the qualifying period.

Carmen Watson, Managing Director of Pertemps Recruitment, said: “What’s crucial is to make businesses aware of how these changes may affect them and discuss the range of initiatives that should be taken.”

Actions may include identifying areas of high risk and carrying out reviews of temporary contracts against those of permanent staff.

The Regulations have been amended to clarify the definition of an agency worker.
